GENERAL TERMS AND CONDITIONS OF SALE FOR THE WORKSHOP

These general conditions govern the purchase and sale of products through the website www.el-workshop.com (hereinafter, the "Website"), operated by El Workshop OÜ, with registered office at Tööstuse tn 75-71, 10416 Tallinn, Estonia, with registry code (registrikood) 17204480 and intra-community VAT number EE102843945. The user (hereinafter, the "Customer") accepts these conditions when making a purchase.

1. OBJECT AND SCOPE OF THE CONDITIONS

These terms and conditions apply to all purchases made through the Website by Customers from any country. El Workshop ships worldwide; shipping costs to each destination are shown before checkout is completed. Shipments outside the European Union may be subject to customs duties, import taxes and customs formalities in the destination country, which, unless otherwise stated, are payable by the Customer. By accepting these terms and conditions, the Customer declares that they are of legal age and have the legal capacity to enter into a contract.

Each product may have specific conditions (for example, production lead times or customisation) shown on its product page, which complement these conditions.

2. REGISTRATION AND PURCHASE PROCESS

Registration is not required to make a purchase. Customers can purchase as a guest or create an account to access additional features.

The purchase process includes:

  • Navigating the Website and selecting the desired products.

  • Adding products to the shopping cart.

  • Fill in the shipping and billing information.

  • Selection of available payment method.

  • Acceptance of these general terms and conditions of sale.

  • Order confirmation by the system.

Once confirmed, the order cannot be modified or cancelled except in the cases provided for by law or in these conditions.

3. PRODUCT INFORMATION

Each product listed on the Website includes a detailed description with its main features, materials, colors, dimensions, and delivery terms. Shipping times are indicated directly in each product listing and are estimates, as they may vary depending on logistical or production circumstances.

The customer is responsible for ensuring that the product dimensions and packaging are compatible with the access points to their home (doors, hallways, stairs, elevators, etc.). The workshop will not be liable if delivery cannot be completed due to access issues.

4. PRICE AND PAYMENT

All prices are shown in euros and include all applicable taxes. However, for the customer's convenience, prices may also be shown in their local currency for reference. Payments must be made exclusively in euros.

Shipping costs are detailed before finalizing the purchase and may vary depending on the product and the customer's location.

The only accepted payment methods are:

  • Credit or debit cards (Visa, Mastercard, etc.).

Payments by bank transfer, cash, or other alternative means are not accepted.

5. DELIVERY

El Workshop manages the delivery of orders, which are prepared and shipped from the warehouses of the manufacturers and suppliers we work with. Delivery times for both in-stock items and made-to-order products are specified in the product listing. These times are estimates and may vary due to logistical or manufacturing reasons.

Once the order has been shipped, the Customer will receive information with the tracking number to check the status of the shipment.

6. RIGHT OF WITHDRAWAL AND RETURNS

6.1 Right of Withdrawal

The customer has the right to withdraw from the purchase contract within 14 calendar days of receiving the product, without needing to justify their decision. This applies exclusively to private consumers and not to businesses or professionals.

To exercise this right, the Customer must initiate a product return request through the Website. Once the request is received, El Workshop will manage the process and provide the relevant instructions.

Returned products must be in perfect condition, unused, and free of stains, odors, or signs of assembly. Reasonable handling equivalent to that which would be carried out in a physical store is permitted.

6.2 Conditions and Costs of Return

The customer will bear the direct costs of returning the product, unless El Workshop has expressly agreed otherwise. Even if the original shipping was free, the return shipping costs will be borne by the customer.

The product must be returned in its original packaging or, failing that, in equivalent packaging that guarantees its protection during transport. The customer is responsible for proper packaging.

6.3 Refunds

The refund will be issued using the same payment method used by the customer, unless otherwise agreed. El Workshop will issue the refund once the product has been received and its condition verified, and in any case, within a maximum of 14 calendar days from said verification.

The transaction fee for payment will not be refunded.

6.4 Exceptions to the Right of Withdrawal

The right of withdrawal cannot be exercised for the following products:

  • If the product is "made exclusively for you" and stated as such on the product page, then it is manufactured only for your order.
  • If the customer customizes the product according to their tastes or measurements.
  • That for hygiene reasons cannot be returned and have been unsealed.

7. DEFECTIVE OR DAMAGED PRODUCTS

The customer must inspect the package upon delivery. If any damage is visible, it must be noted on the carrier's delivery slip. If the damage is not externally visible but is discovered after opening the package, the customer must contact El Workshop through the Website, attaching photos or videos that show the damage.

El Workshop will handle the claim and offer the remedy that applies under the applicable law (repair, replacement, price reduction or refund).

8. LEGAL GUARANTEE OF CONFORMITY

El Workshop, as the seller of the products, is responsible for any lack of conformity of the products under the legal guarantee provided for by the law applicable to consumers.

To make a warranty claim, the Customer must contact El Workshop (info@el-workshop.com), stating the order number and attaching photos or videos that show the lack of conformity. El Workshop will check the claim and apply the remedy set out in the applicable law.

The guarantee does not cover damage caused by improper use, handling contrary to the instructions, or normal wear and tear.

9. RESPONSIBILITY

El Workshop is the seller of the products offered on the Website and is responsible to the Customer for the sale, delivery, returns and warranty, in accordance with the applicable law. To prepare and deliver orders, El Workshop works with manufacturers and logistics suppliers, and is responsible to the Customer for their performance.

However, El Workshop is not responsible for:

  • Delays or incidents caused by force majeure or circumstances beyond its reasonable control.

  • Delivery, access or contact details given incorrectly or incompletely by the Customer.

  • Improper use of the products or handling contrary to the instructions.

Any claim related to the purchase, delivery, return or warranty of a product must be sent to El Workshop at info@el-workshop.com.

11. MODIFICATIONS TO THE CONDITIONS

The Workshop reserves the right to modify these General Terms and Conditions of Sale at any time. The new terms and conditions will be published on the website and will take effect upon publication.

These modifications will not affect purchases made previously, which will be governed by the conditions in force at the time of purchase.

12. APPLICABLE LAW AND JURISDICTION

These terms and conditions are governed by Spanish law. In the event of a dispute, the parties agree to attempt an amicable solution.

If this is not possible, and unless otherwise provided by applicable regulations, the parties submit to the Courts and Tribunals of the city of Valencia (Spain), without prejudice to the legal jurisdiction that corresponds to the consumer.

13. DATA PROTECTION

The processing of personal data will be carried out in accordance with the provisions of Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 on the Protection of Personal Data.
