GENERAL CONDITIONS OF SALE OF THE WORKSHOP

These general conditions regulate the purchase and sale of products through the website www.el-workshop.com (hereinafter, the "Marketplace"), operated by El Workshop OÜ, with registered office at Sepapaja tn 6, 15551 Tallinn, Estonia, and VAT number 17204480. The user (hereinafter, the "Customer") accepts these conditions when making a purchase.

1. PURPOSE AND SCOPE OF THE CONDITIONS

These terms apply to all purchases made through the Marketplace by Customers residing in Spain and Portugal. By accepting these terms, the Customer declares that they are of legal age and have the legal capacity to enter into a contract.

Each product has specific sales conditions indicated by each seller (manufacturer or brand), which may complement these conditions.

2. REGISTRATION AND PURCHASE PROCESS

Registration is not required to make a purchase. Customers can purchase as a guest or create an account to access additional features.

The purchasing process includes:

  • Browsing the Marketplace and selecting the desired products.

  • Adding products to the shopping cart.

  • Filling in the shipping and billing information.

  • Selection of the available payment method.

  • Acceptance of these general conditions of sale.

  • Order confirmation by the system.

Once confirmed, the order cannot be modified or cancelled except as provided for by law or in these terms and conditions.

3. PRODUCT INFORMATION

Each product listed on the Marketplace includes a detailed description with its main features, materials, colors, dimensions, and delivery terms. Shipping times are indicated directly in each product listing and are estimates and may vary depending on logistical or production circumstances.

The Customer is responsible for ensuring that the dimensions of the product and its packaging are compatible with the access points to their home (doors, hallways, stairs, elevators, etc.). The Workshop will not be liable if delivery cannot be made due to access-related reasons.

4. PRICE AND PAYMENT

All prices are shown in euros and include all applicable taxes. However, for the Customer's convenience, prices may also be shown in their local currency as a reference. Payments, in all cases, will be made exclusively in euros.

Shipping costs are detailed before completing the purchase and may vary depending on the product and the Customer's location.

The only accepted payment methods are:

  • Credit or debit cards (Visa, Mastercard, etc.).

Payments by bank transfer, cash, or other alternative means are not accepted.

5. DELIVERY

Products are shipped directly by sellers from their own warehouses. Delivery times for both in-stock and custom-made products are specified directly in the product listing. These times are indicative and may vary due to logistical or manufacturing reasons.

Once the order has been shipped, the Customer will receive information with the tracking number to track the shipment status.

6. RIGHT OF WITHDRAWAL AND RETURNS

6.1 Right of Withdrawal

The Customer has the right to withdraw from the purchase contract within 14 calendar days of receiving the product, without needing to justify their decision. This applies exclusively to private consumers and not to businesses or professionals.

To exercise this right, the Customer must initiate a return request for the product through the Marketplace. Following this request, the seller will manage the process and provide relevant instructions.

Returned products must be in perfect condition, unused, and free of stains, odors, or signs of assembly. Reasonable handling equivalent to that which would be performed in a physical store is permitted.

6.2 Return Conditions and Costs

The Customer will bear the direct costs of returning the product, unless the seller has expressly agreed otherwise. Even if the original shipping was free, the return shipping costs will be borne by the Customer.

The product must be returned in its original packaging or, failing that, in equivalent packaging that guarantees its protection during transport. The Customer is responsible for ensuring proper packaging.

6.3 Refunds

The refund will be made using the same payment method used by the Customer, unless otherwise agreed. The seller will issue the refund once the product has been received and verified in its condition, and in any case, within a maximum of 14 calendar days of such verification.

6.4 Exceptions to the Right of Withdrawal

The right of withdrawal cannot be exercised on products:

  • Manufactured according to the Client's specifications (for example, custom-made furniture).

  • That for hygiene reasons cannot be returned and have been unsealed.

These conditions will be clearly indicated on the product sheet.

7. DEFECTIVE OR DAMAGED PRODUCTS

The Customer must check the condition of the package upon delivery. If any apparent damage is detected, they must note it on the carrier's delivery note. If the damage is not visible externally but is discovered after opening the package, they must contact the seller through the Marketplace, attaching photographs or videos demonstrating the damage.

The seller will handle the claim and offer a solution or compensation as deemed appropriate, without any involvement from The Workshop in this decision.

8. LEGAL GUARANTEE OF CONFORMITY

The warranty for products sold through the Marketplace will be fully assumed by the corresponding seller. In accordance with current regulations, all products have a minimum legal warranty of three years from delivery, applicable only to individual consumers.

The Workshop acts exclusively as a technological intermediary and is not responsible for the quality or legal guarantees of the products.

Acceptance of a return due to non-conformity or product defect is subject to the sole evaluation and approval of the seller, who will be responsible for verifying the merits of the claim and applying, if applicable, the solution established by applicable law.

The Workshop will not be responsible for the costs arising from the management, collection, or resolution of such non-conformity, and does not intervene in the contractual relationship between the Client and the seller beyond providing the platform.

9. RESPONSIBILITY

The Workshop acts solely as an intermediary between the Client and the independent sellers who offer their products through the Marketplace. Under no circumstances does the Workshop participate in the purchase and sale of products or act as a party to the contract between the Client and the seller.

Therefore, The Workshop is not responsible, directly or indirectly, for:

  • The truthfulness or accuracy of the descriptions provided by the sellers.

  • Compliance with delivery deadlines or return conditions.

  • The quality, condition, conformity or guarantee of the products offered.

  • After-sales service or resolution of claims relating to products.

The Customer acknowledges and agrees that any claim related to the purchase, delivery, return, or warranty of a product must be directed directly to the seller through the Marketplace. The Workshop may offer assistance or support in mediation, without assuming any legal obligation in this regard.

11. MODIFICATIONS TO THE CONDITIONS

The Workshop reserves the right to modify these General Conditions of Sale at any time. The new conditions will be published on the website and will take effect upon publication.

These modifications will not affect previously made purchases, which will be governed by the conditions in effect at the time of purchase.

12. APPLICABLE LAW AND JURISDICTION

These conditions are governed by Spanish law. In the event of a dispute, the parties agree to attempt an amicable solution.

If this is not possible, and unless otherwise provided by applicable regulations, the parties submit to the Courts and Tribunals of the city of Valencia (Spain), without prejudice to the legal jurisdiction that corresponds to the consumer.

13. DATA PROTECTION

The processing of personal data will be carried out in accordance with the provisions of Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 on the Protection of Personal Data.
